Allgemeine Geschäftsbedingungen für die Ferienwohnungsvermietung der Mainka & Partner AG. Informationen zu Buchung, Aufenthalt, Haftung und Stornierungsbedingungen. General Terms and Conditions (GTC) Ferienwohnungsvermietung Mainka & Partner AG 1. Geltungsbereich Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für sämtliche Verträge über die mietweise Überlassung von Ferienwohnungen zur Beherbergung, die zwischen der Mainka & Partner AG (nachfolgend „Vermieter“) und ihren Gästen (nachfolgend „Gast“) abgeschlossen werden. Die Leistungen des Vermieters erfolgen ausschliesslich auf Grundlage dieser AGB. Abweichende Bedingungen des Gastes finden keine Anwendung, sofern sie nicht ausdrücklich schriftlich vereinbart wurden. 2. Buchung und Vertragsabschluss Buchungen können über die Website, per E-Mail, telefonisch oder über angeschlossene Buchungsplattformen erfolgen. Ein verbindlicher Beherbergungsvertrag kommt zustande, sobald die Buchung durch die Vermieterin bestätigt wurde und die gemäss Buchungsbestätigung fällige Zahlung eingegangen ist. Mit Abschluss der Buchung akzeptiert der Gast diese AGB. 3. Zahlungsbedingungen • Der Mietpreis sowie allfällige Zusatzleistungen ergeben sich aus der Buchungsbestätigung. • Die Zahlung erfolgt gemäss den bei der Buchung kommunizierten Bedingungen. • Erfolgt die Zahlung nicht fristgerecht, ist die Vermieterin berechtigt, vom Vertrag zurückzutreten und die Ferienwohnung anderweitig zu vermieten. • Gebühren von Zahlungsdienstleistern gehen zulasten des Gastes. 4. An- und Abreise • Die Ferienwohnung steht dem Gast am Anreisetag ab 16:00 Uhr zur Verfügung. • Am Abreisetag ist die Wohnung spätestens um 10:00 Uhr zu verlassen. • Eine verspätete Abreise kann zusätzliche Kosten verursachen. • Kann die Ferienwohnung ausnahmsweise nicht pünktlich bezogen werden, entstehen daraus keine Schadenersatzansprüche. 5. Nutzung der Ferienwohnung Die Ferienwohnung darf ausschliesslich von der bei der Buchung angegebenen Anzahl Personen genutzt werden. Eine Unter- oder Weitervermietung sowie eine Nutzung zu anderen als Wohnzwecken sind untersagt. • Der Gast verpflichtet sich, die Ferienwohnung, das Inventar sowie sämtliche Einrichtungen sorgfältig zu behandeln. • Der Gast haftet für Schäden, die er selbst oder mitreisende Personen verursachen, einschliesslich verlorener Schlüssel oder Zugangsmittel. 6. Haustiere • Ob Haustiere erlaubt sind, richtet sich nach der jeweiligen Ferienwohnung und den Angaben bei der Buchung. • Für erlaubte Haustiere kann ein zusätzlicher Aufpreis erhoben werden. • Haustiere dürfen keine Schäden verursachen und andere Gäste nicht beeinträchtigen. 7. Aufenthalt und Hausordnung Die jeweils geltende Hausordnung ist integraler Bestandteil dieser AGB. • Die Ruhezeiten sind einzuhalten, in der Regel zwischen 22:00 Uhr und 07:00 Uhr. • In den Ferienwohnungen gilt ein Rauchverbot, sofern nicht ausdrücklich anders angegeben. • Bei schwerwiegenden oder wiederholten Verstössen gegen diese AGB oder die Hausordnung ist die Vermieterin berechtigt, das Mietverhältnis fristlos zu kündigen. Ein Anspruch auf Rückerstattung besteht in diesem Fall nicht. 8. Rücktritt / Stornierung durch den Gast • Eine Stornierung der Buchung muss schriftlich erfolgen. • Es gelten die bei der Buchung kommunizierten Stornierungsbedingungen. • Bei Nichtanreise oder vorzeitiger Abreise besteht kein Anspruch auf Rückerstattung. • Der Abschluss einer Reiserücktrittsversicherung wird ausdrücklich empfohlen. 9. Rücktritt durch den Vermieter Die Vermieterin ist berechtigt, aus wichtigen Gründen wie höherer Gewalt, unvorhersehbaren Ereignissen oder technischen Schäden vom Vertrag zurückzutreten. • In diesem Fall beschränkt sich die Haftung auf die Rückerstattung bereits geleisteter Zahlungen. • Weitergehende Schadenersatzansprüche sind ausgeschlossen. 10. Haftung des Vermieters Die Vermieterin haftet im Rahmen der gesetzlichen Sorgfaltspflicht für die ordnungsgemässe Bereitstellung der Ferienwohnung. • Eine Haftung für Ausfälle oder Störungen der Wasser-, Strom- oder Internetversorgung ist ausgeschlossen, soweit gesetzlich zulässig. • Für persönliche Gegenstände des Gastes wird keine Haftung übernommen. • Der Aufenthalt erfolgt auf eigene Verantwortung des Gastes. 11. Nutzung des Internetzugangs (WLAN) • Sofern ein Internetzugang zur Verfügung gestellt wird, erfolgt dies freiwillig und ohne Gewähr für Verfügbarkeit oder Geschwindigkeit. • Der Gast verpflichtet sich, den Internetzugang nicht missbräuchlich zu nutzen. • Für Schäden an Endgeräten oder Daten, die durch die Nutzung des WLANs entstehen, übernimmt die Vermieterin keine Haftung, sofern kein vorsätzliches oder grob fahrlässiges Verhalten vorliegt. 12. Datenschutz Die Bearbeitung personenbezogener Daten erfolgt gemäss der auf der Website veröffentlichten Datenschutzerklärung der Mainka & Partner AG. 13. Gerichtsstand und anwendbares Recht • Es gilt ausschliesslich schweizerisches Recht. • Gerichtsstand ist, soweit gesetzlich zulässig, Immensee, Schweiz. 14. Schlussbestimmungen • Sollten einzelne Bestimmungen dieser AGB ganz oder teilweise unwirksam sein oder werden, bleibt die Gültigkeit der übrigen Bestimmungen unberührt. • Es gilt jeweils die zum Zeitpunkt der Buchung aktuelle Version dieser AGB.
